Under French Business Law the formation of companies in France is generally considerably more complicated and time consuming than in many Common Law jurisdictions. There are numerous types of company structures which are provided for by French Law. The relatively newly introduced Société par Actions simplifiée (S.A.S.) is finding favor though with a number of foreign, particularly US, corporations which are setting up subsidiaries in France.
French Business Law also covers areas such as agency and distribution. Corporations outside France wishing to sell their product or service in France may envisage a number of different means by which Agency agreements, Distribution agreements and Franchise agreements are developed.
Commercial leases are highly regulated and, to a considerable degree, standardized by French statute. For example, a standard 9-year term for French Commercial Leases is fixed by statute. There are breakpoints at the end of each three-year period (3-6-9), but only in favor of the tenant.
